Welcome to The Can Valet (“The Can Valet,” “Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website and any services provided by The Can Valet.
By creating an account, scheduling service, purchasing a subscription, or using our website, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our services.
1. Services
The Can Valet provides garbage container management services for residential and commercial customers. Services may include, but are not limited to:
- Moving trash, recycling, and green waste containers to the curb before scheduled collection.
- Returning containers to their designated storage location after collection.
- Vacation and temporary service options.
- Short-term rental (Airbnb/VRBO) trash can management.
- One-time or recurring services.
- Additional services offered through our website.
Services are available only within our designated service areas.
2. Customer Responsibilities
The Customer agrees to:
- Provide accurate contact and billing information.
- Provide the correct service address.
- Ensure garbage containers are accessible on each service day.
- Keep walkways reasonably safe and free from hazards.
- Notify us of any changes to garbage collection schedules.
- Notify us if moving, canceling service, or changing service locations.
The Can Valet is not responsible for missed collections resulting from incorrect information provided by the Customer.
3. Property Access
By purchasing our services, you authorize The Can Valet and its employees or contractors to enter the exterior areas of your property solely for the purpose of providing the requested services.
We will never intentionally enter your home or any locked structure.
If access is blocked by locked gates, vehicles, animals, construction, weather conditions, or other obstacles, service may be skipped.
4. Service Schedule
The Can Valet will make every reasonable effort to place containers at the curb before your scheduled collection day and return them afterward.
Service times are estimates only.
We are not responsible for delays caused by:
- Weather
- Traffic
- Vehicle breakdowns
- Road closures
- Natural disasters
- Illness
- Holidays
- Changes made by your waste collection provider
- Any event beyond our reasonable control
If your waste collection company changes its schedule without your knowledge or without notifying us, The Can Valet is not responsible for any missed collection.
5. Subscription Billing
Many of our services are offered as recurring monthly subscriptions.
By purchasing a subscription, you authorize The Can Valet to automatically charge your selected payment method according to your chosen billing cycle until canceled.
Subscription pricing may change from time to time. We will provide reasonable notice before any price changes take effect.
If a payment cannot be processed, we may suspend or terminate your service until payment is received.
Returned payments, declined cards, or chargebacks may result in additional fees and/or suspension of service.
5A. Authorization for Recurring Payments
By enrolling in any recurring subscription service offered by The Can Valet, you expressly authorize The Can Valet and its payment processor to automatically charge your selected payment method for all recurring subscription fees, applicable taxes, and any authorized additional charges associated with your account.
Your subscription will automatically renew at the end of each billing period unless canceled in accordance with these Terms.
You are responsible for maintaining accurate and current payment information. If your payment method expires, is declined, or otherwise becomes invalid, you authorize us to retry the payment and to contact you regarding updated payment information. Service may be suspended or terminated if payment cannot be successfully processed.
You agree not to dispute or initiate a chargeback for recurring charges that are consistent with the subscription plan you selected and these Terms. If you believe a billing error has occurred, you agree to contact The Can Valet first so we can investigate and attempt to resolve the issue.
If a chargeback or payment reversal is initiated for valid charges, The Can Valet reserves the right to suspend or terminate service, recover any unpaid amounts, and pursue any remedies available under applicable law.
By completing your purchase, checking any required acceptance box, or otherwise enrolling in recurring service, you acknowledge that you have read these Terms and authorize recurring automatic payments until your subscription is canceled in accordance with our Cancellation Policy.
6. Cancellation Policy
You may cancel your subscription at any time through your account or by contacting us.
To avoid being charged for the next billing cycle, cancellation must be received before your next scheduled renewal date.
If cancellation is received after a renewal has been processed, service will remain active through the end of the current billing period.
7. Refund Policy
Because we reserve service availability and scheduling based on active subscriptions:
- Monthly subscription fees are generally non-refundable after the billing period begins.
- Partial-month refunds are not provided.
- One-time service fees are non-refundable once the scheduled service has begun.
- Refunds may be issued at our sole discretion or where required by applicable law.
If The Can Valet fails to provide a scheduled service due solely to our error, we may, at our discretion:
- Return and complete the missed service as soon as reasonably possible; or
- Provide an account credit or partial refund.
These remedies are the Customer’s exclusive remedies for missed services.
8. Missed or Delayed Services
Occasionally services may be delayed due to circumstances outside our control.
Whenever practical, we will attempt to notify affected customers.
A delayed service does not automatically entitle the Customer to a refund.
9. Customer Property
The Can Valet exercises reasonable care while handling your garbage containers.
However, we are not responsible for:
- Existing damage to containers
- Normal wear and tear
- Damage caused by sanitation workers
- Damage caused by third parties
- Damage caused by severe weather
- Faded, cracked, or deteriorated containers
Customers are responsible for ensuring containers are structurally sound.
10. Suspension or Refusal of Service
We reserve the right to refuse, suspend, or terminate service if:
- Payment is overdue.
- Unsafe conditions exist.
- Our employees are threatened or harassed.
- Animals create unsafe conditions.
- Fraudulent information is provided.
- These Terms are violated.
11. Limitation of Liability
To the fullest extent permitted by law, The Can Valet shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to our services.
Our maximum liability for any claim shall not exceed the amount paid by the Customer for the service giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless The Can Valet, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
- Unsafe property conditions.
- Incorrect information provided by the Customer.
- Violation of these Terms.
- Misuse of our services.
- Negligence or intentional misconduct by the Customer.
13. Website Use
All content on this website, including text, graphics, logos, images, designs, software, and trademarks, is owned by or licensed to The Can Valet.
You may not copy, reproduce, modify, distribute, or use any content without our prior written permission.
You agree not to:
- Attempt unauthorized access to our systems.
- Use automated tools to scrape website data.
- Upload malicious software.
- Interfere with website operation.
14. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
15. Communications
By creating an account or purchasing services, you agree that The Can Valet may contact you regarding:
- Service reminders
- Schedule changes
- Billing notices
- Account notifications
- Customer support
You may unsubscribe from promotional emails at any time, but you may continue to receive transactional communications necessary to provide your service.
16. Force Majeure
The Can Valet shall not be liable for delays or failure to perform services resulting from circumstances beyond our reasonable control, including but not limited to:
- Severe weather
- Floods
- Wildfires
- Earthquakes
- Utility outages
- Government actions
- Labor disputes
- Pandemics
- Vehicle failures
- Acts of God
17. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.
Any legal action relating to these Terms shall be brought in the state or federal courts located in California, unless otherwise required by law.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Changes to These Terms
We reserve the right to modify these Terms at any time.
Updated Terms become effective immediately upon posting to our website unless otherwise stated.
Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
20. Entire Agreement
These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and The Can Valet regarding our services.
